Terms and Conditions of Use for Space. Educational Satellite Kit
Effective Date: 10 Sep 2024These Terms and Conditions of Use (“Terms”) govern your use of the Space. Educational Satellite Kit (“the Product”) provided by TYAR (“we,” “us,” or “our”). By purchasing, using, or accessing the Product, you (“User”) agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the Product.
1. Acceptance of Terms
* By using the Product, you acknowledge that you have read, understood, and agree to abide by these Terms. These Terms constitute a binding agreement between you and TYAR.* If you are using the Product on behalf of an organization (e.g., a school or university), you confirm that you have the authority to bind that organization to these Terms.
2. Eligibility
* The Product is designed for educational purposes and is intended for use by schools, universities, educators, and students. Users under the age of 18 must use the Product under the supervision of an adult (e.g., a teacher or parent).* By using the Product, you represent that you are either of legal age to form a binding contract or have received parental/guardian consent to do so.
3. Permitted Use
* The Product is intended for educational and research purposes only. You agree to use the Product solely for its intended purposes as described in the accompanying documentation.* You may not use the Product for commercial purposes, reverse engineer its components, or use it in any manner that violates local, state, national, or international laws.
4. Intellectual Property Rights
* All intellectual property rights related to the Product, including but not limited to software, designs, logos, and documentation, are owned by TYAR or its licensors.* You are granted a limited, non-exclusive, non-transferable license to use the Product for educational purposes. This license does not grant you any ownership rights over the intellectual property associated with the Product.
5. Privacy and Data Collection
* Use of the Product is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Product, you agree to the terms outlined in our Privacy Policy.* If the Product collects user-generated data (e.g., experiment results), you consent to the collection and use of this data for educational, research, and product improvement purposes.
6. User Responsibilities
* You are responsible for ensuring that the use of the Product complies with all applicable laws and regulations.* If using the Product in an educational setting, you are responsible for supervising students and ensuring safe and appropriate use.

9. Limitation of Liability
* To the maximum extent permitted by law, TYAR shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Product.* TYAR’s total liability, in any case, shall not exceed the amount paid for the Product.
10. Indemnification
* You agree to indemnify, defend, and hold harmless TYAR and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Product or violation of these Terms.11. Governing Law
* These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.12. Changes to Terms
* TYAR reserves the right to modify these Terms at any time. The updated Terms will be posted on our website, and the “Effective Date” will be revised. Your continued use of the Product after changes are posted constitutes your acceptance of the modified Terms.13. Termination
